1. Acceptance of Terms

By accessing and using this website (the "Site"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, please discontinue use of the Site.

These terms apply to all visitors, enquirers, and clients of Mosswick. Use of our advisory services is also subject to a separate client engagement agreement, which will be provided before any engagement commences.

2. About Us

Mosswick is a business advisory practice operating in Malaysia. Our principal place of business is 22 Jalan Bukit Bintang, 55100 Kuala Lumpur. References to "we", "our", or "us" in these terms refer to Mosswick.

3. Use of the Website

You may use this Site for lawful purposes and in a manner consistent with its intended use. You agree not to:

  • Use the Site in any way that violates applicable Malaysian law or regulation.
  • Transmit any unsolicited or unauthorised advertising or promotional material.
  • Attempt to gain unauthorised access to any part of the Site or its infrastructure.
  • Introduce malware, viruses, or other harmful code.
  • Scrape, copy, or reproduce content from the Site without our prior written consent.
  • Misrepresent your identity or affiliation when using the Site or submitting enquiries.

We reserve the right to suspend or restrict access to the Site at our discretion, without prior notice, if we have reason to believe these terms have been breached.

4. Advisory Services

The information on this Site is for general reference purposes and does not constitute professional advice. Our advisory services are delivered under a written engagement agreement that sets out scope, deliverables, fees, timelines, and conditions specific to each engagement.

We make reasonable efforts to ensure the accuracy of the information presented on this Site, but we cannot warrant that it is complete, current, or free from error. We encourage you to contact us directly with specific questions before making any decisions based on information found here.

Outcomes described in case studies or client references on the Site reflect the specific circumstances of those engagements. They are illustrative and not indicative of results that can be expected in any particular situation.

5. Fees and Payment

Fees for our advisory services are outlined in each client engagement agreement. Prices shown on this Site are indicative and may vary based on scope, complexity, and timing. All prices are quoted in Malaysian Ringgit (RM) and are exclusive of applicable taxes, unless stated otherwise.

Payment terms, milestone structures, and invoicing arrangements will be detailed in the relevant engagement agreement. We reserve the right to revise our service fees; any such changes will not affect engagements already under agreement.

6. Intellectual Property

All content on this Site — including text, graphics, logos, layout, and structure — is the intellectual property of Mosswick or its licensors and is protected under applicable Malaysian and international intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our prior written consent. Brief quotations for non-commercial reference purposes are acceptable, provided they are properly attributed to Mosswick and a link to the original page is included where possible.

Work product delivered under a client engagement agreement is governed by the intellectual property terms in that agreement, which typically transfer ownership of final deliverables to the client upon full payment.

7. Confidentiality

We take the confidentiality of client information seriously. Our confidentiality obligations are set out in each client engagement agreement. Information shared with us during the enquiry phase is treated with discretion and will not be disclosed to third parties without your consent, except where required by law.

We ask that you also treat any non-public information shared by us in the course of an engagement — including methodologies, frameworks, and process documentation — with appropriate confidentiality.

8. Limitation of Liability

To the extent permitted by Malaysian law, Mosswick shall not be liable for any indirect, incidental, consequential, or special loss or damage arising from your use of this Site or our advisory services, even if we have been advised of the possibility of such loss.

Our total liability to you in connection with any engagement shall not exceed the total fees paid by you under the relevant engagement agreement.

Nothing in these terms limits our liability for fraud, gross negligence, or any liability that cannot be excluded by law.

9. Third-Party Links

This Site may contain links to third-party websites. These links are provided for your convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them. The inclusion of a link does not imply our endorsement of the linked site or its operator.

10. Termination and Suspension

We reserve the right to terminate or suspend access to this Site or any of our services at any time and without prior notice, particularly where there is reason to believe these terms have been breached or where continued provision is not practical.

Termination of an advisory engagement is governed by the terms of the relevant engagement agreement, which typically includes notice provisions and provisions for work completed to date.

11. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from these terms or your use of this Site shall be subject to the exclusive jurisdiction of the courts of Malaysia.

We are, however, open to resolving disputes through good-faith discussion before resorting to formal proceedings, and we welcome the opportunity to address any concern directly.

12. Changes to These Terms

We may revise these Terms and Conditions from time to time. The revised version will be published on this page with an updated effective date. Your continued use of the Site after any such changes constitutes your acceptance of the revised terms.

For ongoing client engagements, changes to the engagement-specific terms require written agreement from both parties.
